These Terms of Service (the “Terms”) govern use of FrankenDojo, the language practice app provided by KataSpeak (“we”, “us”, or “our”), including its iOS, Android, and web practice versions and related services (the “Service”). By using the Service, you agree to these Terms.
Article 1 (Scope)
- These Terms apply to all relationships between us and users concerning use of the Service.
- Any additional rules or guidelines we publish within the Service form part of these Terms.
- Personal information is handled under our separate Privacy Policy.
- If you use the Service through the App Store or Google Play, that store's terms also apply. If they conflict with these Terms, the store's terms take precedence for billing matters.
Article 2 (Eligibility)
- Minors must obtain consent from a parent or other legal guardian before using the Service.
- Anyone previously suspended for violating these Terms may not use the Service.
Article 3 (Accounts)
- Some features are available to guests (anonymous users); others require registration with a Google or Apple account.
- You are responsible for managing your account. You must not allow a third party to use it, or transfer or lend it to anyone.
- We are not liable for damage resulting from unauthorized use of an account, except in cases of our willful misconduct or gross negligence.
- You may delete your account at any time using the in-app feature. Deleted data cannot be restored.
Article 4 (Service, Free Plan & Paid Plan)
- The Service supports language practice through audio playback, shadowing, speech detection, and related features. It does not guarantee learning outcomes or improved language skills.
- The app displays which features are free and which require the paid (Premium) plan.
Article 5 (Paid Plan & Subscription)
- The paid plan is a monthly, automatically renewing subscription. Subscription Plan: $1.99 / month (or equivalent in your local currency). Actual prices may vary depending on your country and Google Play Store settings. The purchase screen sets out the applicable price and initial 14-day free trial terms.
- Unless you cancel during the free trial, billing begins automatically on the day after the trial ends. The trial is limited to once per person, subject to store and other applicable rules.
- Your subscription automatically renews for the same period unless you cancel at least 24 hours before the current period ends.
- Manage or cancel your subscription as follows:
- iOS: Settings >Apple ID>Subscriptions
- Android: Subscriptions in Google Play
- Web: The customer portal opened through “Manage subscription” in the app
- After cancellation, you can continue to use paid features until the end of the period already paid for.
- Except where required by law, refunds follow the rules and procedures of the relevant store (Apple or Google) or Stripe. We may be unable to issue refunds directly.
- We will announce changes to prices or offerings in advance on the purchase screen or in the app, in accordance with applicable laws and store rules.
- Payments are processed by the App Store, Google Play, or Stripe (web version, through RevenueCat). We do not obtain payment details.
Article 6 (Prohibited Activities)
You must not:
- Violate laws or public order and morals;
- Copy, redistribute, resell, or publicly transmit the Service's materials, audio, images, programs, or other content, except as permitted by law or expressly allowed by the Service;

- Reverse engineer, decompile, or analyze the Service, except where permitted by law;
- Improperly enable testing administrator features or flags, or circumvent billing or usage limits;
- Overload servers or networks, or gain unauthorized access;
- Infringe others' rights, including copyright, portrait rights, or privacy;

Article 7 (User-imported Content)
- You warrant that you have the lawful right to use any audio files or other content you import (“User Content”).
- User Content is generally processed on your device and is not stored by us. However, we may process it temporarily to the extent necessary to provide the Service.
- We are not liable for importing or sharing User Content that infringes third-party copyrights or other rights.
- If you share segmentation data or similar content with others, you are responsible for the content and for choosing its recipients.
Article 8 (Intellectual Property)
- Intellectual property rights in the Service and official materials, including audio, scripts, illustrations, characters, programs, and trademarks, belong to us or their lawful owners.
- We grant you a non-transferable, non-exclusive, revocable right to use the Service for personal learning in accordance with these Terms.
- Open-source software included in the Service is subject to its respective licenses.
Article 9 (Microphone & Other Permissions)
- The Service may use the microphone for speech detection and the camera for QR code scanning. These require operating system permission, which you may change at any time in your device settings.
- Practice with the screen off, including bedtime practice, operates only after you start it. You are responsible for managing your surroundings, effects on sleep, battery use, and communication costs.
Article 10 (Changes, Interruptions & Termination)
- We may change or interrupt all or part of the Service without prior notice due to maintenance, failures, natural disasters, outages or changes in external services (including Firebase, RevenueCat, Cloudflare, and app stores), or other circumstances.
- We may terminate all or part of the Service with reasonable advance notice. If we terminate it for our own reasons during a paid subscription period, we will take appropriate action in accordance with the law.
- Our liability for resulting damage is limited as set out in Article 12.
Article 11 (Suspension & Account Deletion)
If you violate these Terms or we suspect misuse, we may suspend access, delete your account, or restrict downloads without prior notice. We are not liable for resulting damage.
Article 12 (Disclaimers & Limitation of Liability)
- The Service is provided as is. We do not warrant that it is free of factual or legal defects, including issues with safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or infringement of rights.
- Speech detection results may be inaccurate depending on the environment, device, or audio.
- Except in cases of our willful misconduct or gross negligence, our liability is limited to ordinary damage directly incurred by you, and shall not exceed the total fees you paid us in the 12 months preceding the damage.
- Where the Consumer Contract Act or other mandatory laws invalidate any of the above provisions in whole or in part, those laws prevail to that extent.
- You must resolve disputes with third parties at your own responsibility and expense.
Article 13 (User Information)
We handle user information according to our Privacy Policy. You consent to information being transmitted to and processed by Google, RevenueCat, Cloudflare, Stripe, and other providers as described in that policy.
Article 14 (Changes to the Terms)
- We may amend these Terms without your consent when we consider it necessary, pursuant to Article 548-4 of the Civil Code of Japan.
- We will give notice of amended Terms a reasonable time before their effective date, through the app or public website. Continued use of the Service after the change constitutes agreement to the amended Terms.
Article 15 (No Assignment)
You may not transfer your status, rights, or obligations under these Terms to a third party, or use them as security, without our prior written consent.
Article 16 (Severability)
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
